I am voluntarily submitting personal information, photographs and other information (the “Submission”) for consideration by Illinois Agricultural Association ("IAA") to be a Field Mom. All statements in my Submission are true. I am the person who appears in the picture I submitted. The use of my Submission for or in connection with IAA and the Field Moms program will not violate or infringe on any third party’s rights.

I submit that I am:

• At least 18 years of age, and a legal resident of Illinois.
• Only submitting one Submission to be a Field Mom.
• Physically and legally able and willing to travel to locations around Illinois.
• A mother of at least one child under 13 living at my residence.

IAA, in its sole discretion, may disqualify me if anything in the Submission is not true.

I represent and warrant that:

• The Submission is my own original, previously unpublished, and previously unproduced work.
• As of the date of submission, the Submission is not the subject of any actual or threatened litigation claim.
• The Submission does not and will not violate any applicable laws.
• If the Submission contains persons other than myself or third party elements not owned by me, that I have obtained express written consent to submit such element as part of my Submission from such person(s) or owner(s) of such third party element(s) and, if requested to do so, I can produce such written consent in a form and manner acceptable to IAA.

Selection: I understand and agree that information in the Submission will be used for purposes of selecting the Field Moms program of the Illinois Agricultural Association. The Submission may be shared between IAA and its communications/advertising firms. In the event I am selected to participate as a Field Mom, I will be required to sign the Participant Agreement and background check authorization form that will be provided to me at a later date. In the event I fail to sign the Participant Agreement, background check authorization form and any other documents that IAA may require, I will forfeit my opportunity to participate as a Field Mom. I understand IAA is not obligated to select me as a Field Mom, even if I meet all the requirements. I understand that the decision about who to include as a Field Mom shall be made by IAA and its communications/advertising firms in their sole discretion, and shall be final, binding, and not subject to challenge or appeal.

IAA will reimburse for reasonable travel and child care expenses, as determined solely by IAA, for Field Mom participants.

Use of the Submission: I irrevocably and unconditionally agree that IAA shall own the Submission (including the copyright and all other rights embodied therein) and that IAA and its designees shall have the right (but not the obligation) to use the Submission for or in connection with the Field Mom program, including posting on the Illinois Farm Families website) and for all other commercial purposes in any and all media now known or ever in the future throughout the universe in perpetuity at no charge to IAA and without further permission for use. IAA shall have those rights, whether or not the Submission is selected to be a Field Mom. IAA and its designees shall have the right to post, exploit, publish, add to, subtract from, change, revise or otherwise edit the Submission, including, without limitation, my name, biographical information and likeness embodied therein, and I release and will indemnify IAA from and against any claims arising out of such actions or the use of any rights granted herein. I waive all rights that I may have under any laws or status worldwide that concern “moral rights” or “droit moral” in connection with the Submission, unless prohibited by law.

I understand IAA assumes no responsibility for any similarities between any Submission and any future advertising or promotional activities or other initiatives undertaken by IAA.

This Agreement contains the full and complete understanding between us, supersedes all prior agreements and understandings, and cannot be modified except in writing by IAA. I understand and agree that any and all claims I may have related to the Field Mom program will be resolved by final and binding arbitration before a single arbitrator, as named by IAA. The arbitrator shall decide only my and/or IAA’s individual claims, and the arbitrator shall not have the power to award punitive damages. I agree that the internal laws of the State of Illinois, United States of America, shall govern (without giving effect to Illinois or U.S.A. choice or conflict of law principles that would result in the application of any other jurisdiction’s laws) and that venue for the resolution of any dispute shall be in Bloomington, Illinois, U.S.A. The invalidity or unenforceability of any part of the Agreement shall in no way affect the validity or enforceability of any of the other terms contained in this Agreement.
